Terms & Conditions of listing:

Toowoomba Regional Council (“we”  or “council”) offers access to our Community Information Directory (“the directory”) and use of our site to you subject to the acceptance of these terms and conditions (“Terms”). Unless you accept all of these terms, your application for inclusion in the Directory cannot be accepted or processed.

1. Ownership

Council owns and has copyright on this site and its content. You must comply with the Copyright Statement as published on this site. Your use of and access to the directory does not grant you any rights to use, publish, transmit or otherwise reproduce the contents of the directory or this website in any way other than that allowed in accordance with the Copyright Statement.

Council encourages external website links to the directory from your or associated websites. However, these references and links must comply with council’s copyright and linking policies and must not mislead website users as to the actual ownership and authorship of the directory. The TRC's Community Information Directory website must be opened as a new web page and not framed or otherwise implied to be part of the original linking site as this may be considered to breach the council’s copyright with appropriate action being taken.

Further, use of the TRC logo and its associated logos are protected under laws governing intellectual property and copyright. If you wish to use the council logo in any manner, including the use of an embedded link to a logo on our site, prior approval must be obtained by contacting us via email or in writing to:

2. Disclaimer

By using this site and the directory, you acknowledge and accept the terms of the Disclaimer Statement.

Further, we accept no responsibility for errors, omissions or misrepresentations made in the information provided by you or for any loss, damage, cost or expense (whether direct or indirect) incurred by you or any other site users relying on the information contained within the directory.

You acknowledge and accept that any information provided by your organisation is the responsibility of your organisation.

You also acknowledge and accept that where you provide links to other sites that we do not operate or control (linked sites), we accept no responsibility for these other sites. We offer this service for your and the users' reference and convenience. Use of a link to your related website in the directory does not provide Toowoomba Regional Council endorsement for the contents of the site or the products or services offered and does not imply that the views on that website are those of the Toowoomba Regional Council or indicate its commitment to a particular course of action.

You acknowledge that any linked sites attached to your listing in the directory are your sole responsibility and are subject to your terms, conditions and disclaimers. Further, you agree to defend and indemnify council from any action brought as a result of use of a linked site.

3. Privacy

Your use of our site and the directory is subject to our Privacy Statement. You acknowledge that you have read the Privacy Statement and that you understand and accept this statement and the information practices contained in that Statement.

4. Access to the directory

By providing an application for entry into the directory, or an application to vary or remove a listing from the directory, you are accepting that you are appropriately authorised by the individual or organisation making the application. Further, you agree that you have the capacity to enter into binding contracts. This site is not available to minors.

Appropriately authorised applicants would include:

  • members of the organisation’s management committee – eg. President, Vice-President, Treasurer or Secretary
  • the group leader or spokesperson
  • a delegate authorised at a management committee meeting, acknowledged through the minutes of such meeting
  • an employee of the organisation employed in a management or administrative capacity; or
  • a legal representative of the organisation.

After initial application, future access to your listing within the directory will be via website links sent to your registered contact email address. It is your responsibility to ensure the security of the email address supplied and access to your listing at all times. Where you believe your listing has been compromised or otherwise dealt with using unauthorised access, you agree to notify council immediately upon becoming aware of the situation.

Council will suspend listings where notification of unauthorised access has been provided or where it is reasonably suspected that unauthorised access has occurred. You will be required to contact us to re-instate your listing.

5. Eligibility for entry into the directory

The TRC Community Information Directory is designed as a resource for the members of the region to find community services and facilities to improve, support and enrich their lifestyles.

The directory is open to organisations who:

  • operate on a not-for-profit basis, and
  • do not operate significant commercial activities, and
  • are open to the public, and
  • provide a service or product in the community interest, and
  • operate within the Toowoomba Regional Council boundaries or are a regional or state group of interest to the Toowoomba Regional Community, and
  • accept the terms and conditions of listing in the directory and use of the website, and
  • provide the relevant information in the format required.

Where you or your organisation, does not meet all the relevant criteria you can apply to council for special consideration for entry in the directory. Acceptance is based upon:

  • not having a significant commercial purpose
  • operating in the community interest
  • exclusion from the directory would negate/reduce potential community benefit, and
  • council’s discretion and no correspondence will be entered into.

Toowoomba Regional Council owned and/or operated facilities, services or enterprises, are automatically eligible for a listing in the directory. This condition overrides any other condition which precludes similar or identical non-council facilities, services or enterprises, from being included in the directory.

6. Content of the directory

By contributing information to a listing within the directory, you accept that you hold all necessary rights (including copyright) to the information being presented. Further you guarantee that nothing you contribute is defamatory in nature or infringes any law or regulation.

When you submit content to the directory in any format - text, logos, graphics and other material - you grant council a non-exclusive, royalty-free, perpetual license to publish or otherwise deal with that content, now and in the future.

You agree to take full responsibility for all content contributed and will indemnify TRC against all damages including legal and accounting costs that may be incurred as a result of a breach of the guarantee above.

While council agents and employees make every effort to maintain current and accurate information on this site, we accept no responsibility for errors, omissions or misrepresentations in information within this site. Further, you accept responsibility to check your listing in the directory and agree to make your own corrections (where required) to ensure your listing is accurate, complete and representative of the facts by using the Add / Maintain Listing option provided.

Council reserves the right to suspend or change listings at any time where it is considered inappropriate, inaccurate, incomplete, misrepresentative, of ill-taste, not in the community interest, defamatory, derogatory or otherwise unsuitable. Where this occurs we will provide reasons to you in writing. However, council’s decision will be final and no further correspondence will be entered into.

7. Undertaking to maintain up-to-date listing

Continued use and success of the directory depends on regular is maintenance of accurate and up-to-date listings.

We understand that organisation details including contact people, addresses, hours of operation and many other factors will change from time to time.

By contributing to the directory, you agree to maintain an accurate, complete, up-to-date listing. In order to assist you with this, every six (6) months we will forward a system-generated email to your registered email address requiring you to log into your listing, review the data, make relevant changes or confirm that no changes are required.

Where you fail to respond to this request within thirty (30) days, your listing will be suspended and removed from public access until you contact us.

8. Use of data contributed to the directory

The purpose of the directory is to provide a listing of an extensive range of community services and facilities to improve and enrich our lifestyle in the Toowoomba region.

The data will be available through council’s Community Information Directory website to view online and print on a listing-by-listing basis.

Further, users of the website will be able to download a free pdf version of the entire listing provided they keep only one (1) hard copy and use it only for private, non-political or non-commercial purposes.

Hard copies of the directory can be purchased from Council in accordance with the annual Schedule of Fees and Charges.

Council reserves the right to use the information within the directory to:

  • contact you in relation to your directory listing
  • send information to you from time to time that we think you may find of interest (eg. on behalf of other government departments or community groups)
  • notify you of council offerings, services or other information
  • forward you surveys or feedback requests in relation to the directory or other council services
  • for other relevant purposes.

9. General

Your acceptance of these Terms and use of the site does not create a joint venture, partnership, employment or agency relationship with council.

We may modify these Terms, at any time, by posting a conspicuous notice on our site at least thirty (30) days before the changes come into effect. Your continued listing within the directory after the changes have been notified and come into effect will be your acceptance of the new terms.

These Terms and Conditions will be governed by the laws of the State of Queensland, Australia.

If any of these Terms are deemed to be invalid, unenforceable or illegal for any reason, the remaining terms will continue to operate in full force.

10. Termination

The Terms and Conditions continue to operate until terminated by council.

Council may, at any time and without notice, terminate or suspend your listing within the directory where persons or organisations fail to comply with the terms and conditions, fail to meet the eligibility requirements or make inappropriate use of the site or otherwise at our own discretion.

Where this occurs, council undertakes to provide you with reasons for the suspension or termination, however, council’s decision will be final and no further correspondence will be entered into.

All restrictions on use of data, disclaimers and limitations of liability will continue to exist. However, you will no longer be entitled to a listing within the directory.

Privacy Statement:

This site is operated by the Toowoomba Regional Council using both council and commercial web hosting and development facilities. Council respects your privacy and acknowledges the principles developed in the Guidelines for Federal Government Websites developed by the Australian Privacy Commissioner and other legislative requirements including, but not limited to:

  • Information Privacy Act 2009
  • Public Records Act 2002
  • Right to Information Act 2009
  • Freedom of Information Act 1992
  • Spam Act 2003.

Site visit data

When visiting the site, some details of your visit are logged for statistical purposes. We use this information to improve the quality and performance of the site. Your server provides us with the following information:

  • your server address
  • your top level domain name ( e.g. .com, .gov, .au, .org etc)
  • the date and time of your visit to the site
  • the pages you accessed and documents downloaded
  • the previous site visited
  • your browser type.

No attempt will be made to identify users or their browsing activities except in the unlikely event of an investigation, where a law enforcement agency may exercise a warrant to inspect the internet web server logs.

Any information provided to council through the use of online systems will be used for official local government administration only. This information will not be passed on to third parties.

Cookies

A cookie is a piece of information that a website can transfer to an individual’s computer hard drive for record-keeping. Cookies make websites easier to use by storing information about your usage and preferences for a particular website. The information remains on your computer after the internet session finishes. Cookies can be used by this website.

Contacting council by email

Council will record your email address and message when you contact us for queries in relation to the directory, reporting a fault or listing violation or providing feedback.

Your email address will only be used for the purpose for which you supplied it and will not be added to a mailing list unless authorised by you. We will not use your email address for any other purpose, and will not disclose it, without your consent.

You should be aware that all messages sent to council become part of council’s records and may be retrieved by a key word searchable archive in accordance with the relevant legislation listed above. Your attention is drawn to the fact that council is subject to Freedom of Information and Right to Information requests in accordance with the relevant legislation, and persons other than the intended recipient may access your email message.

Listing information provided for use in the directory

The purpose of the directory is to provide a comprehensive listing of community services and facilities available within Toowoomba Regional Council boundaries. The directory is intended as a public access document, either electronically through the website or as a printed document available to members of the public.

Individuals or organisations providing information for listing in the directory acknowledge and accept that the details will be provided publicly on the website and in the printed document available for public access. You should be aware that access to the directory will not be limited and the information provided will be available to all internet users and anyone requesting a printed copy. Internet access potentially provides access to millions of world-wide users and the information can be searched for using an identifier such as your name. You should note that the information can be copied and used by any web user and that council has no control over the use and disclosure of the data once it has been published.

Users of the data must comply with the copyright and other legal restrictions as contained in the disclaimer and copyright statements on this site.

Provision of an application for listing within the Directory will be your authorisation for public display of the information provided.

Other uses of listing data provided in the directory

Council reserves the right to use the information within the Directory to:

  • contact you in relation to your directory listing,
  • send out information to you from time to time that we think you may find of interest (eg. on behalf of other government departments or community groups),
  • notify you of council initiatives, services or other information,
  • forward you surveys or feedback requests in relation to the directory or other council services, or
  • for other relevant purposes.

If council is required to provide the data to external parties (for example, to an external IT provider) for those parties to fulfil their service obligations to council, we will take reasonable steps to ensure that these parties deal with your data in accordance with our privacy principles.

Security of Information

Council takes care to ensure that the data provided through the directory website is protected. For example our website has electronic security systems in place, including the use of firewalls and data encryption. However, it should be noted that there can be risks associated with the transmission over and publication of information on the internet.

From time to time we may need to update or revise our Privacy Statement. Council reserves the right to make these changes at any time, and without prior notice. Any changes will be notified to you by posting an updated Privacy Statement on the website.
